Terms of Service

1. Introduction

These Terms of Service (hereby referred to as "Terms") set forth the conditions for using the Anical mobile application (hereby referred to as "Application") provided by freeweb (Developer: Akira Kawata, hereby referred to as "Service Provider").

2. Agreement to Terms

By downloading or using the Application, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Application.

The Application is provided as a free service and is intended for use "AS IS".

You and the Service Provider acknowledge that these Terms are concluded between you and the Service Provider only, and not with Apple Inc. ("Apple"). The Service Provider, not Apple, is solely responsible for the Application and its content. These Terms do not provide for usage rules that conflict with the Apple Media Services Terms and Conditions as of the Effective Date.

3. Changes to Terms

The Service Provider may update these Terms at any time without prior notice. Updated Terms shall become effective upon being posted on this webpage.

Your continued use of the Application after any changes constitutes acceptance of the new Terms. You are advised to review these Terms periodically for any changes.

4. License Grant

Subject to your compliance with these Terms, the Service Provider grants you a non-exclusive, non-transferable, limited license to use the Application for personal, non-commercial purposes. If you obtained the Application through the Apple App Store, the license is limited to a non-transferable license to use the Application on any Apple-branded products that you own or control, as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that such Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.

5. Intellectual Property

All intellectual property rights in the Application and its content (including but not limited to design, text, graphics, logos, and icons) belong to the Service Provider or its licensors.

Third-party content provided through the Application, such as anime information, belongs to their respective rights holders (including MyAnimeList). The Application displays this information through the Jikan API and does not claim any rights to such content.

You and the Service Provider acknowledge that, in the event of any third party claim that the Application or your possession and use of the Application infringes that third party's intellectual property rights, the Service Provider, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such intellectual property infringement claim.

7. Third-Party Services

The Service Provider assumes no responsibility for the content, accuracy, safety, or availability of these third-party services. You must comply with applicable third-party terms of agreement when using the Application. You are responsible for reviewing the terms of use of each service at your own discretion.

8. Disclaimer of Warranties

The Application is provided "AS IS" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or usefulness.

The Service Provider is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Application to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Application, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be the Service Provider's sole responsibility.

9. Limitation of Liability

Damages caused by the Service Provider's intentional acts or gross negligence are excluded from the limitations set forth in this section.

Except as stated above, the Service Provider's total liability for any claims arising from or related to the Application shall not exceed 1,000 JPY. This limitation of liability shall not apply where it is deemed invalid under the Consumer Contract Act or other applicable laws.

10. Modifications and Termination of Service

The Service Provider may modify the specifications or functionality of the Application at any time without prior notice.

The Service Provider may temporarily or permanently suspend or discontinue the Application at any time without prior notice. The Service Provider assumes no responsibility for any damages arising from such changes, suspension, or discontinuation.

11. User Data

The Application stores user data (watchlist, settings, search history, etc.) exclusively in the device's local storage. This data is never transmitted to any external server.

You can delete all on-device data at any time by selecting "Delete All Data" in the Settings screen within the Application.

For details on how user data is handled in the Application, please refer to the Privacy Policy. The Privacy Policy is incorporated into these Terms by reference.

12. Termination

You may terminate your use of the Application at any time by uninstalling it from your device.

The Service Provider may terminate a user's access to the Application without prior notice if the user violates these Terms.

Upon termination, the provisions of Section 5 (Intellectual Property), Section 8 (Disclaimer of Warranties), Section 9 (Limitation of Liability), and Section 13 (Governing Law and Jurisdiction) shall remain in full force and effect.

13. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Japan.

Any disputes arising from or in connection with these Terms or the Application shall be subject to the exclusive jurisdiction of the Chiba District Court as the court of first instance.

14. Maintenance and Support

The Service Provider is solely responsible for providing any maintenance and support services with respect to the Application, as specified in these Terms or as required under applicable law. You and the Service Provider acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Application.

15. Product Claims

You and the Service Provider acknowledge that the Service Provider, not Apple, is responsible for addressing any claims of yours or any third party relating to the Application or your possession and/or use of the Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. These Terms may not limit the Service Provider's liability to you beyond what is permitted by applicable law.

16. Legal Compliance

You represent and warrant that: (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

17. Third Party Beneficiary

You and the Service Provider acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of these Terms, and that, upon your acceptance of the terms and conditions of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third party beneficiary thereof.

18. Miscellaneous

If any provision of these Terms is held to be invalid or unenforceable by law, the remaining provisions shall continue in full force and effect.

These Terms constitute the entire agreement between you and the Service Provider regarding the use of the Application and supersede all prior agreements on the subject matter.
